Terms and Conditions
Welcome to Hidden Creek. These Terms and Conditions govern your use of our services and website. By engaging our services or using this site, you agree to these terms.
Please note that these Terms and Conditions can be superseded by the provisions of your individual contract.
1. Services Provided
Hidden Creek provides professional residential and commercial maintenance, landscape design, landscape construction, irrigation system service and installation, pool service and installation, and related outdoor living services referred to as “Services.” The scope and description of work will be outlined in individual proposals, estimates, or contracts provided to each client.
2. Payment Terms
2.1 Estimates and Approval
All work begins after you accept an estimate in writing or electronically. Estimates are valid for 30 days from the issue date unless otherwise specified.
2.2 Deposits
For design, enhancement or construction projects, a nonrefundable deposit may be required before work begins. Deposit amounts will be listed in your estimate or contract.
2.3 Payment Methods
We accept payment by credit card, debit card, ACH, check, wire transfer, eCheck, or other methods listed on your invoice.
2.4 Due Dates
Unless otherwise specified, payment is due upon receipt of invoice or according to the payment schedule outlined in your contract.
2.5 Late Fees
Invoices not paid by the due date may incur a late fee of 3% per month on any unpaid balance.
2.6 Changes in Scope or Materials
Additional work, materials, or unforeseen conditions discovered after work begins may require an updated estimate, deposit and client approval prior to additional work starting.
3. Liability and Property Access
3.1 Performance of Work
Hidden Creek will perform all Services in a professional manner consistent with industry standards.
3.2 Client Responsibilities
Clients are responsible for providing safe and timely access to the property. Hidden Creek is not liable for damage to property that is not reasonably visible or disclosed prior to the commencement of work.
3.3 Utility Clearance
Clients must ensure underground utilities are properly marked. Hidden Creek is not responsible for damage to utilities that were not marked or located before work begins.
3.4 Weather and Delays
Weather, supply shortages, labor availability, or other conditions beyond our control may delay project timelines. Hidden Creek is not liable for costs resulting from delays outside of our control.
3.5 Existing Conditions
Hidden Creek is not responsible for damage to client owned equipment, irrigation components, drainage systems, lighting, or decorative features that were not disclosed prior to work.
4. Cancellations, Rescheduling, and No Shows
4.1 Project Cancellations
If you cancel a design or construction project after contract signing but before work begins, you may forfeit any deposit paid.
4.2 No Shows
If Hidden Creek arrives for a scheduled service appointment and is unable to perform work due to lack of access, client absence, or other client related reasons, a service call or rebooking fee may apply.
5. Privacy and Data Use
5.1 Data Collection
We collect customer information including name, address, contact details, and project information to provide services, schedule work, and communicate with you.
5.2 Use of Information
Customer information may be stored in our systems, and internal business records to manage estimates, scheduling, invoicing, and payments.
5.3 Third Parties
We do not sell personal information. Data may be shared with subcontractors, suppliers, or software providers solely as necessary to fulfill the scope of work.
5.4 Security
Hidden Creek takes reasonable steps to protect customer information. However, no system is completely secure, and we are not liable for unauthorized access outside of our control.
6. Dispute Resolution
6.1 Good Faith Resolution
If a dispute arises, both parties agree to attempt resolution in good faith through direct communication.
6.2 Legal Resolution
If informal resolution is unsuccessful, disputes may be resolved through mediation, arbitration, or legal action in the appropriate court of Ohio.
6.3 Governing Law
These Terms and Conditions are governed by the laws of the State of Ohio.
7. Amendments
Hidden Creek may update these Terms and Conditions from time to time. Changes are effective upon posting to our website or providing notice to clients.
